1. Agreement to Terms

By accessing or using StoreCraft (the "Service"), you agree to be bound by these Terms of Service ("Terms"). StoreCraft is operated by StoreCraft Pty Ltd (ABN to be registered) ("we", "us", "our"), an Australian company. If you do not agree to these Terms, you must not use our Service.

These Terms are governed by the laws of Australia, including the Australian Consumer Law ("ACL") as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the ACL or any other applicable law that cannot be excluded, restricted, or modified by agreement.

2. Description of Service

StoreCraft provides a software-as-a-service (SaaS) e-commerce platform that allows users to create, manage, and operate online stores. Our Service includes:

  • Online store creation and hosting
  • Product catalogue management
  • Order processing and management
  • Payment processing integration (via Stripe)
  • AI-powered content generation tools
  • Analytics and reporting
  • Customer management tools

3. Account Registration

To use our Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including if we believe that your conduct violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. Subscription Plans and Payment

We offer various subscription plans as detailed on our pricing page. All prices are displayed in Australian Dollars (AUD) and include GST where applicable.

4.1 Free Trial

Paid plans include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time during the trial without charge.

4.2 Billing

Subscriptions are billed monthly in advance. Payment is processed through Stripe, and you agree to Stripe's terms of service for payment processing. You authorize us to charge your designated payment method for all fees incurred.

4.3 Price Changes

We may change our subscription prices upon 30 days' notice. Price changes will take effect at the start of the next billing period following the notice.

4.4 Refunds

We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with our Service within the first 14 days of your paid subscription, contact us for a full refund. After 14 days, subscription fees are non-refundable, except as required by Australian Consumer Law.

5. Acceptable Use

You agree not to use our Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Sell prohibited, illegal, or regulated items without proper licensing
  • Distribute malware, spam, or engage in phishing activities
  • Harass, abuse, or harm others
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Collect personal information without consent
  • Engage in fraudulent activities or misrepresent your identity

6. Your Content and Store

You retain ownership of all content you upload to your store ("Your Content"). By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit Your Content solely for the purpose of providing the Service.

You are solely responsible for:

  • The accuracy of product descriptions and pricing
  • Compliance with consumer protection laws in your jurisdiction
  • Fulfilling orders and providing customer service to your customers
  • Handling refunds and disputes with your customers
  • Collecting and remitting applicable taxes
  • Obtaining necessary business licenses and permits

7. AI-Generated Content

Our Service includes AI-powered tools for generating product descriptions, images, and social media content. You acknowledge that:

  • AI-generated content is provided "as is" and should be reviewed before use
  • You are responsible for ensuring AI-generated content is accurate and appropriate
  • AI-generated content may not always be original and should be checked for potential IP issues
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by StoreCraft and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

"StoreCraft" and our logo are trademarks of StoreCraft Pty Ltd. You may not use these trademarks without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 1 of these Terms regarding consumer guarantees:

  • Our total liability to you for any claim arising from or relating to these Terms or the Service is limited to the amount you paid us in the 12 months prior to the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
  • We are not liable for any loss or damage resulting from your failure to keep your account credentials secure

If you are a consumer under the Australian Consumer Law, you may have rights and remedies that cannot be excluded, restricted, or modified. Nothing in these Terms excludes, restricts, or modifies those rights and remedies.

10. Indemnification

You agree to indemnify and hold harmless StoreCraft, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload to the Service
  • Your operation of your online store, including disputes with your customers

11. Service Availability and Modifications

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

For Max plan subscribers, we provide an SLA guarantee as detailed in your subscription agreement.

12. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be issued for the remaining period (except as required by law)
  • Your store will be deactivated and data will be retained for 30 days
  • You may request data export before the 30-day retention period ends

We may terminate or suspend your account immediately for serious breaches of these Terms.

13. Dispute Resolution

If you have a dispute with us, please contact us first at support@storecraft.app. We will try to resolve the dispute informally within 30 days.

If we cannot resolve the dispute informally, either party may refer the dispute to mediation administered by the Australian Disputes Centre. If mediation is unsuccessful, either party may pursue legal remedies in the courts of New South Wales, Australia.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and StoreCraft regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
